Spouse Visa / Partner Visa
As a British Citizen or UK resident with no immigration restrictions, you are eligible to bring your spouse or partner to the UK.
Eligibility criteria for UK Spouse Visa are:
• You and your spouse are over 18 years’ old.
• You are planning to live together permanently.
• The financial requirement of £29,000 per annum has to be met unless exemption applies.
• You have to fulfill the English language requirement.
Note that your spouse has to earn this amount or more and support you without claiming UK public funds unless you are exempted to meet the financial requirements.
You can meet the financial requirements through a mixture of income of employment or self-employment, sick pay, maternity or paternity pay, income coming from rent or shares or cash savings.
Fiancé Visa
Are you a non EEA citizen wishing to join your fiancé(e) in the UK?
In order to apply for a fiancé(e) visa, your partner must have British Citizen or settled status in the UK. The Fiancé(e) Visa is commonly referred to as Proposed Civil Partner Visa. In order to qualify for a fiancé(e) visa you and your future spouse:
–Must be 18 years or older.
–Have met each other before.
–Must anticipate to live together.
–Must show that any previous relationship has been dissolved.
–Must have adequate funds to support yourselves, without having to claim public funds.
–Your fiancé must earn over the minimum requirement of £29,000 per year


Visitor Visa/Family Visitor/
Medical Visitor/Business Visitor
Visit Visas are provided to individuals who do not plan to make the UK their home. These individuals should be to visiting the UK for a short term to do certain permitted activities.
In order to satisfy the conditions for the visa route the visitor:
• Is destined to leave the UK after their visit, and
• Will retreat from the UK by the end of their visit, and
• Will not reside in the UK for prolonged periods by means of repeated or consecutive visits, or make the UK their primary home.
Long Residence
If you have been in the UK legally for ten years you can apply to settle.
Settling also known as Indefinite Leave to Remain means you can stay in the UK without any time restrictions.
You are eligible to settle if you:
➢ Have been lawfully continuously living in the UK for 10 years.
Note that during your continuous residence period you can leave the UK for up to:
• 180 days at a time
• 540 days throughout the whole period
Note that you can’t count:
• time spent in a prison, secure hospital or a young offender’s institution
• time spent in the Republic of Ireland, Channel Islands or Isle of Man

Private Life Route:
The Private Life route is for a person seeking permission to stay in the UK on the basis they have developed a Private Life in the UK.
A child born in the UK to a person who has permission on the Private Life route can apply for permission for the same duration as their parent.
The Private Life route is a route to settlement.
A child born in the UK who has been continuously resident for 7 years may qualify for immediate settlement on this route.
Alternative routes may be available to those considering the Private Life route. For example, a person may be able to qualify for immediate settlement on the basis of 10 years Long Residence in the UK, under Appendix Long Residence of these rules.
Residence requirements for a child on the Private Life route:
1. Where the applicant is aged under 18 at the date of application the following
requirements must be met:
- The applicant must have been continuously resident in the UK for at least 7
years; and - The decision maker must be satisfied that it would not be reasonable to
expect the applicant to leave the UK.
Residence requirements for a young adult on the Private Life route (where the applicant arrived in the UK as a child):
Where the applicant is aged 18 or over and aged under 25 at the date of application and
arrived in the UK before the age of 18, the applicant must have spent at least half their
life continuously resident in the UK.
Residence requirement for an adult on the Private Life route:
Where the applicant is aged 18 or over on the date of application:
- The applicant must have been continuously resident in the UK for more than
20 years; or - Where the applicant has not been continuously resident in the UK for more
than 20 years, the decision maker must be satisfied there would be very
significant obstacles to the applicant’s integration into the country where they
would have to live if required to leave the UK.
Settlement / Indefinite Leave to Remain in the UK on Private Life Route
You may be eligible for indefinite leave to remain (ILR) on the basis of your private life in
the UK if either:
- you have been continuously living in the UK with a visa for 5 years as a
child/young child or 10 years as an adult. - you were born in the UK and have lived here continuously up to the age of at
least 7Please note that you can include the time you’ve spent on any other visas which lead to
indefinite leave to remain which is called a qualifying period. However, you must have
had a visa based on your private life for at least one year on the day you apply for
indefinite leave to remain.
Application Fees
It costs £2,885 for each person applying.
Knowledge of language and life in the UK
Unless exempted you must meet the requirements of knowledge of language and life in
the UK as stated under the immigration rules appendix private life.
Family members
Partner:
Your partner may also be able to get indefinite leave to remain.
If they meet the requirements for ILR under the private life route, they can apply
separately.
Children:
If your children do not meet the criteria but were born in the UK, they may
still be able to get indefinite leave to remain as your dependant if:
(i) you’re applying or have applied for indefinite leave to remain on the basis of your
private life;
(ii) they were born in the UK
(iii)One of the following must also be true:
- your child’s other parent is currently applying for indefinite leave to remain in
the UK - your child’s other parent already has indefinite leave to remain
- your child’s other parent is a British citizen
- you’re the child’s sole surviving parent
- you have sole responsibility for your child
- there are serious or compelling reasons why your child should be allowed to
stay – they’ll normally already have permission to be in the UK for the same
reasons.
(iv)Your child must also not be married, in a civil partnership or living an
independent life.
If your child is eligible, you must apply for them separately. You cannot add your child to
your own application.
